Terms of Service

1. Acceptance of Terms

By accessing or using the Learner360 platform ("Service"), the school ("you", "your") agrees to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Learner360 is a student relationship intelligence platform that provides schools with tools including student questionnaires, wellbeing tracking, safeguarding alerts, intervention logging, and AI-powered data queries.

3. School Responsibilities

• You are responsible for ensuring appropriate use of the platform by your staff and students
• You are the data controller for all student and staff data entered into Learner360
• You must obtain all necessary consents from students and parents before using the platform
• You must keep login credentials secure and not share admin accounts
• You must notify us immediately of any suspected security breach
• You must use the platform in compliance with applicable law, including UK GDPR

4. Acceptable Use

You agree not to:

• Use the platform for any unlawful purpose or in violation of safeguarding legislation
• Attempt to access data belonging to other schools
• Reverse engineer, copy, or redistribute any part of the platform
• Upload malicious code or attempt to compromise platform security
• Use the AI query feature to generate harmful or inappropriate content

5. Subscription & Payment

• Subscriptions are billed monthly in advance
• Prices are as listed on our website at time of subscription
• We reserve the right to change pricing with 30 days notice
• No refunds are provided for partial months
• Failure to pay may result in suspension of access

6. Data & Privacy

Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Service, you agree to the Privacy Policy.

We act as data processor on your behalf. A Data Processing Agreement (DPA) is available on request for schools requiring formal GDPR documentation.

7. AI Features

The AI query feature uses the Anthropic Claude API. By using this feature, you acknowledge that student response data is transmitted to Anthropic for processing. You should ensure this is disclosed to relevant parties per your school's GDPR obligations. We do not use this data for training AI models.

8. Safeguarding

Learner360 provides automated safeguarding alerts as a support tool only. These alerts do not replace professional safeguarding judgement. Schools remain solely responsible for their safeguarding procedures, referrals, and compliance with statutory guidance (e.g. Keeping Children Safe in Education).

9. Availability & Support

• We aim for 99% uptime but do not guarantee uninterrupted service
• Planned maintenance will be communicated in advance where possible
• Support is provided via email at info@learner360.co.uk
• Response times: within 2 business days for standard plans, within 1 business day for Secondary/Enterprise

10. Intellectual Property

All platform code, design, templates, and content are the intellectual property of Learner360. Schools retain ownership of all data they input into the platform.

11. Termination

• Either party may terminate with 30 days written notice
• We may suspend or terminate immediately for breach of these Terms
• Upon termination, your data will be exported to you on request and deleted within 30 days

12. Limitation of Liability

To the maximum extent permitted by law, Learner360 shall not be liable for indirect, incidental, or consequential damages arising from use of the Service. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified by email with 30 days notice. Continued use after the notice period constitutes acceptance.
